In consideration of being allowed to participate in any way in the Event, I hereby acknowledge, appreciate, and agree that:
As in all shooting events/sports, there are inherent risks, hazards and dangers from my participation in this Event, including, but not limited to the possibility of injury and the loss of life and/or limbs (or use thereof); and while particular rules, equipment, and personal discipline may reduce these risks, hazards and dangers, the possibility of serious injury does exist. By participating in this Event, I recognize and understand the inherent risks, hazards and dangers involved in the Event in particular, and recreational shooting in general, and further agree not to hold Lallemand Biofuels & Distilled Spirits at 1815 Satellite Boulevard, Building 200, Duluth, Georgia (“LBDS”), its officers, officials, agents, employees or representatives liable for any injury or property damage resulting from my participation in or attendance at this Event. I KNOWINGLY AND FREELY ASSUME ALL AFOREMENTIONED RISKS, HAZARDS AND DANGERS both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF LBDS.
I assume full responsibility for personal injury to myself and loss or damage to my personal property and expenses thereof including, but not limited to, loss of wages, medical expenses, court costs, and attorney fees that may incur as a result of my or other participants’ participation in this Event. I release LBDS its officers, officials, agents, employees or representatives from any claims, disputes, liabilities, causes of actions, suits, controversies, or damages of any kind or nature that may result from my participation in this Event, including but not limited to WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF LBDS OR OTHERWISE. It is my express intent that this Waiver of Risk shall bind the members of my family and spouse, if I am alive, and my heirs, assigns, and personal representative, if I am deceased and shall be deemed as a release, waiver, discharge and covenant not to sue.
I further understand that LBDS reserves the right to refuse any person from participating in the Event at any time for any reason whatsoever including, but not limited to, incapacity or unsafe actions caused by apparent intoxication or influence of alcohol or drugs.
In signing this Waiver of Claims, I acknowledge and represent that I am at least eighteen (18) years of age or older and that I have read, understand, signed voluntarily as my own free act and deed, and accept the terms and conditions stated herein and acknowledge that this Waiver of Claims shall be effective and binding upon the aforementioned parties.
