Use of recreational equipment in the ocean and/or participation in a water recreational activities such as snorkeling, surfing, stand-up paddling, and boogie boarding involves significant inherent risks which may result in serious bodily injury and/or death. I understand and agree that I am renting equipment for my own use, with no guide, instructor, or specifications for use of the equipment and I agree that 1800Snorkel LLC and its affiliate or subsidiary corporations, or any of their respective employees, officers, agents, contractors or assigns (hereinafter “Released Parties”) will not be liable or responsible in any way for any injury, death or other damages to me, my family, my estate, heirs or assigns, that may occur as a result of my use of the equipment or as a result of the negligence of any party, including Released Parties.
I understand that some of the inherent risks of water/ocean recreation include: Hazardous conditions of the ocean such as strong currents, undertows, changing tides, high surf, reef and shore break, waves breaking in shallow water, adverse weather conditions, and wind; bodily injury such as heat and weather exposure, dehydration, motion sickness, sunburn, extreme exertion, heart attack, panic, hyperventilation, and drowning, sinus problems, difficulty breathing, danger posed by other participants in water related activities, and danger posed by vessels, including being run over by them; capsizing; equipment failure; contact with marine life/conditions such as sharp coral, slippery rocks, sharks, fish, stinging jelly fish, turtles, eels, and man-o-war, any and all of which may cause me harm; collision with buoys, rocks, debris, shores, boats, equipment, and swimmers and/or users of recreational equipment; injuries such as bruises, bites, cuts, contusions, burns, strains, sprains, fractures, concussions, paralysis and drowning.
My use of the rented recreational equipment is purely voluntary. I hereby release from liability and waive any and all claims that I have or may have in the future against the Released Parties. I voluntarily agree to fully and forever release, indemnify, hold harmless and defend the Released Parties from and against any and all claims, damages, losses, expenses, liabilities of
every kind, including but not limited to attorneys fees, in any way arising out of or in connection with my activities under this Release. I voluntarily waive my right to sue Released Parties for any injuries or damages that may result from renting equipment. I
ACKNOWLEDGE THAT I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT, THAT I HAVE DONE SO AND THAT I UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM.
