This document is to be signed by the "Swimmer" together with "The Parent and/or Legal Guardian" in order to participate in the tryouts and assessment process for the Edmonton Keyano Swim Club, and related events and activities (collectively referred to as the “Tryout/Assessment”).
I/We, the undersigned Swimmer and the parent(s) and/or guardian(s) of the Swimmer, are aware that the Tryout/Assessment involves inherent risks, dangers and hazards, involving all manner of injury or loss, including potentially serious or life-threatening injury and death, property damage, property loss or any other loss or expense resulting to the Swimmer or myself/ourselves, arising without restriction from:
(a) the use of equipment, materials or facilities related to the Tryout/Assessment;
I/We, the undersigned Swimmer and the parent(s) and/or guardian of the Swimmer, acknowledge that EKSC relies upon the pool facility maintenance/operation, safety policies, and lifeguard resources and/or training of the operator of the pool facility in which the Tryout/Assessment occurs, freely accept and assume all risks, dangers and hazards as contemplated above or otherwise, and hereby agree as follows:
(a) To Waive Any And All Claims of every nature and kind at law or equity or under any statute that I/we have or may have in the future against EKSC;
(b) To Release EKSC from any and all liability for injury, death, property damage, property loss or any other loss or expense that I/we may suffer or that my next of kin or legal representatives may suffer as a result of participation in or use of the Tryout/Assessment, due to any cause whatsoever, including negligence on the part of EKSC;
(c) To Hold Harmless And Indemnify EKSC from any and all liability for injury, death, property damage, property loss or any other loss or expense to any party, including myself, as a result of participation in the Tryout/Assessment, or other financial loss or expense including, without restriction, legal expenses and costs on a solicitor-and-his-own-client full indemnity basis in defending against such claims or enforcing the terms contained within this document;
(d) and That This Agreement Will Be Effective And Binding Upon myself, and my/our heirs, next of kin, executors, administrators and assigns.
I/We, the undersigned Swimmer and/or the parent(s) and/or guardian of the Swimmer, hereby acknowledge that we have read the foregoing, and have had the opportunity to ask questions and clarifications before signing, and have explained its meaning to the Swimmer. We acknowledge that we understand its content, impact and meaning, and hereby consent, approve and agree to the above.
