Dive Division Rental Kayak, SUP & E-Bike Release
By signing this release, I certify that I am fully aware of and expressly assume these and all other risks involved in Kayaking and Stand-Up Paddle Boarding or Ebike, bike trip whether conducted as a recreational activity or a Lesson or a Tour. I understand and agree that neither Blue Bay Dive & Watersports, Dive Division, Dive Division retail store (DAW Curacao B.V.), Coral Divers BV, Jan Thiel Diving BV, Groove Diving, nor any of its respective employees, owners, officers, agents or assigns or resorts, nor the crew or owners of the vessels, nor the vessel may be held liable or responsible in any way for any occurrence on any Kayak/Stand-Up Paddle Boarding/E-Bike or bike trip with or without Blue Bay Dive & Watersports, Dive Division, Dive Division retail store (DAW Curacao B.V.), Coral Divers BV, Jan Thiel Diving BV, Groove Diving, that may result in personal injury, property damage, wrongful death or other damage to me or my family, heirs, or assigns that may occur as a result of my participation in these Kayak(s) and Stan-Up Paddle Board(s) or as a result of the negligence of any party, including the Released Parties, whether passive or active.
I am aware that if a paddle gets lost while paddling, kayaking, or under any other circumstances, I will have to pay to Blue Bay Dive & Watersports, Dive Division, Dive Division retail store (DAW Curacao B.V.), Coral Divers BV, Jan Thiel Diving BV, Groove Diving, from which I rented the Equipment, the cost is $ 50 USD per paddle, a Kayak or Stand-up Paddle Board the cost is $ 400 USD.
I am only allowed to stay inside of the bay, not passing by the wave breakers at any time. If I do get out of the bay, for whatever reason, this is completely at my own risk. In case I cannot return, for whatever reason, the coast guard or in company rescue team will be contacted to help bring me back. I will be held responsible for all costs meaning I will have to pay the amount the Coast Guard or rescue team charges for this or any other costs the Blue Bay Dive & Watersports, Dive Division, Dive Division retail store (DAW Curacao B.V.), Coral Divers BV, Jan Thiel Diving BV, Groove Diving, has to make to get me back.
I further state that I am of legally competent to sign this liability release, or that I have obtained the written consent of my parent or guardian.
BY THIS INSTRUMENT, I DO HEREBY EXEMPT AND RELEASE ALL THE ABOVE LISTED ENTITIES AND/OR INDIVIDUALS FROM ALL LIABILITY AND RESPONSIBILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH, HOWEVER, CAUSED, INCLUDING, BUT NOT LIMITED TO, PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I ACKNOWLEDGE THAT I HAVE READ THE FOREGOING PARAGRAPHS, FULLY UNDERSTAND THE POTENTIAL DANGERS INCIDENTAL TO ENGAGING IN THIS AND ALL BOAT TRIPS AND SCUBA DIVE(S)/SNORKEL/FISH TRIPS,E-BIKING, CYCLING, KAYAKING OR STAND UP PADDLE, AM FULLY AWARE OF THE LEGAL CONSEQUENCES OF SIGNING THIS INSTRUMENT, AND THAT I UNDERSTAND AND AGREE THAT THIS DOCUMENT IS LEGALLY BINDING AND WILL PRECLUDE ME FROM RECOVERING MONETARY DAMAGES FROM THE ABOVE LISTED ENTITIES AND/OR INDIVIDUALS, WHETHER SPECIFICALLY NAMED OR NOT, FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE.
