2018 SHORELINE ENTERTAINMENT, LLC (ACWORTH SLIDE) WAIVER

In consideration of the services of SHORELINE ENTERTAINMENT LLC (ACWORTH SLIDE), THE CITY OF ACWORTH, and the U.S. ARMY CORPS OF ENGINEERS their agent, owners, officers, volunteers, participants, employees and all other persons or entities acting in any capacity on their behalf hereinafter collectively referred to as “SECA”, I hereby agree to release, indemnify, and discharge SECA on behalf of myself, my spouse, my children, my parents, my heirs, assignees, personal representatives and estate as follows.

By checking this box, I agree ... I do not have any pre-existing conditions such as back, neck, leg, or arm injuries. I am not pregnant. I am at least 18 years of age (or) I am under 18 years of age and my parent or legal guardian is present and is signing the waiver of liability on my behalf. I acknowledge that my participation in riding the ACWORTH SLIDE entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death or damage to myself, property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. I acknowledge that risks include among other things being thrown from the slide that could result in musculoskeletal injuries including head, neck, and back injuries. I acknowledge that SECA is not responsible for ascertaining my physical fitness or abilities. I acknowledge that SECA is not responsible for equipment defects or malfunctions. I am participating at my own risk. My participation is purely voluntary, and I elect to participate in spite of the risks. I understand that riding the slide is an inherently dangerous activity and hereby release SECA, its employees, owners, and participants, and the owners, participants, and employees of the grounds and establishment wherein the slide is operated, from any claims, demands, and causes of action, including any and all liability and negligence or omissions resulting in personal injuries or even death arising from my participation in the slide or getting thrown from the slide. Should SECA or anyone acting on their behalf, be required to incur attorney’s fees to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force effect. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating or else I agree to bear the costs of such injury or damage to myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. I acknowledge that the weight restriction per slider is 250 LBS, I agree that I weigh less that 250 LBS. I acknowledge that the height restriction per slider is 42 inches tall, I agree that I am taller than 42 inches. * Please check it here.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against SECA on the basis of any claims from which I have released them herein. I have had sufficient opportunity to read this entire document, have read and understand it, and I agree to be bound by its terms.
