I hereby acknowledge and agree to the following rental agreement and release of liability for services provided by Seattle E-Bike Rental:
Rental Agreement Rules of Service:
The renter must be 18 years or older, agrees to wear a helmet while riding, and agrees to lock the bike securely at all times when it is not in use.
Payment must be made in full at the time of reservation. Charges are refundable if cancelled 7 days or more before the reserved pickup date. Bike rental and accessories must be returned at the scheduled time each day.
The renter will be held liable for damage beyond normal wear and tear. The renter will be held liable for loss or theft if the renter does not lock the bike securely at all times when it is not in use as required by this agreement. No deposit is required, however, by signing this agreement the renter authorizes Seattle E-Bike Rental to invoice for damage, loss, or theft as applicable.
Release of Liability:
Assumption of Risk: I understand and accept that renting this bike and participating in biking exposes me to many hazards that may entail unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in biking, and I confirm that I have no significant health issues that prevent me from participating in biking. I have no medical conditions, nor have I been diagnosed with a condition that prevents me from biking. In spite of the aforementioned risks and acknowledgements, I hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this bike and participating in biking. I understand the inherent risk involved in using this rental biking equipment and accept full responsibility for any and all such damage or injury which may result. A helmet has been provided to me and I will wear a helmet at all times. I understand that wearing a helmet may decrease but not eliminate the risk of head injury.
Waiver And Release: I specifically release and forever discharge Seattle E-Bike Rental from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this bike and participating in biking. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Seattle E-Bike Rental or its affiliates, officers, agents, or employees. I release Seattle E-Bike Rental and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by negligence or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this bike or participating in biking, I will have no right to make a claim or file a lawsuit against Seattle E-bike Rental or its affiliates, officers, agents or employees.
I HAVE CAREFULLY READ THIS AGREEMENT IN ITS ENTIRETY AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK AND WAIVER AND RELEASE OF LIABILITY, AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
