I acknowledge that this Release will be used by MetroPCS Massachusetts, LLC (“MetroPCS”) in connection with my participation in the Ultimate Fighting Championship experience on January 20, 2018, which includes striking a dummy (the “Event”), and that this Release will govern my participation and responsibilities at the Event.
As lawful consideration for being permitted to participate in the Event, I, on behalf of myself, my personal representatives, heirs, beneficiaries, relatives, executors, administrators, next of kin, successors and assigns hereby voluntarily agree not to make any claim against or sue MetroPCS, its authorized dealers, or the respective parent companies, subsidiaries, affiliates, officers, directors, employees, contractors, or agents of Zuffa, LLC and MetroPCS (collectively, the “Released Parties”). I do hereby release, waive, forever discharge and agree to hold harmless, defend and indemnify the Released Parties from any and all liability, claims or demands for personal injury, sickness, loss of services or death, as well as property damage and expenses, of any nature whatsoever which may be incurred by me while I am participating in the Event or which arise out of participation in the Event, participation in Event-related promotions, contests, and/or use of product samples, prizes, or giveaways, whether or not arising from negligence or carelessness on the part of the Released Parties, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the Released Parties.
I acknowledge that there is risk involved in my participation in the Event and the potential for property loss, serious injury, and death. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, equipment, and actions of other people. I hereby assume all of the risks of participating in this Event and represent that I have no medical or physical condition that would endanger me as a result of my participation, that I am the age of majority in my state of residence or older, and further represent that I am not under the influence of drugs or alcohol at the time of my executing this Release or at the time of participation in the Event. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident and/or illness during the Event; however, I understand and acknowledge that neither MetroPCS nor any other Released Party has any obligation to provide medical treatment and have not undertaken any responsibility to do so. I fully release the Released Parties and the person(s) providing such care from any and all liability whether resulting from negligence or otherwise.
This Release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. If any provision of this Release is held invalid under any applicable law, such invalidity will not affect any other provision that can be given full effect without the invalid provision. This Agreement shall be governed and construed pursuant to the laws of the State of Texas without reference to its conflict of laws rules.
I HAVE CAREFULLY READ THIS AGREEMENT. I UNDERSTAND THAT IT IS A COMPLETE RELEASE OF LIABILITY AND PROMISE NOT TO SUE OR TO MAKE A CLAIM. I WARRANT THAT I AM AT LEAST THE AGE OF MAJORITY IN MY STATE OR RESIDENCE OR OLDER.
