In considering the entertainment gaming experience provided by Escape Space Games San Marcos, I (and/ or my guardian) agree to the following…
1. Waiver and Release: I am aware of the risks and dangers of the escape gaming experience and in my participation in this experience I agree not to hold Escape Space Games San Marcos responsible. Either by the negligence of the owners, employees, or agents of accidents or by negligence of myself or any participants in my party. I assume all risks and dangers. I take full responsibilities for loss or damages whether caused in whole or in part by negligence or conduct of owners, employees, or agents of Escape Space Games San Marcos. I do hereby release, forever discharge, and hold harmless Escape Space Games San Marcos and all its owners, employees, or agents of any and all liability, claims, and demands of whatever kind or nature that may arise as a result of my participation in the escape gaming experience provided by Escape Space Games San Marcos. By signing below, I discharge Escape Space Games San Marcos and all of its owners, employees, or agents from any liability or claim that I or anyone on my behalf could have or bring against Escape Space Games San Marcos with respect to any bodily injury, illness, death, property damage or any other damages of any nature, whatever the cause of such claims.
2. Medical Treatment: I and/or my guardian hereby permit the owners, employees, or agents of Escape Space Games San Marcos to arrange for emergency medical, surgical, or dental care treatment deemed reasonably necessary in their sole discretion. I agree that I am responsible for all charges incurred in connection with such care and treatment. I understand Escape Space Games San Marcos holds no obligation to provide financial assistance or other assistance including but not limited to medical, dental, or disability insurance or benefits. In the event of injury or illness.
3. Insurance: I understand that Escape Space Games San Marcos does not carry or maintain health, medical, or disability insurance coverage for me. I understand that Escape Space Games San Marcos encourages me to obtain my own health insurance coverage.
4. Disputes: I agree that all disputes, claims, and causes of action arising out of or connected with my presence at or participation in an Escape Space Games San Marcos event shall be resolved individually, without resort to class action. This Release and any issues and questions regarding its construction, validity, interpretation, or enforceability shall be governed by the law of the state of Texas. I agree that Hays County, Texas, shall be the sole venue for the resolution of any legal matter arising out of or connected with any claim that I may bring against Escape Space Games San Marcos.
5. Photographs: I give Escape Space Games San Marcos and any affiliates or assigns permission to use and/ or replicate my name, likeness, images (including video and audio recordings), and opinions for promotional purpose in any social media, worldwide, without further payment, unless otherwise prohibited by law.
6. Intellectual property: I understand that by signing this document I am agreeing not to use any confidential material I encountered at Escape Space Games San Marcos to further my own material benefit of any organization or business I am affiliated with.
