I, the undersigned, hereby acknowledge that I am the parent/guardian of a minor child under the age of 18 years old (the “Minor”). In consideration of the Minor’s participation in activities at Oishei Children's Hospital 818 Ellicott Street, Buffalo, NY 14203 (the “Event”), I agree on behalf of myself and the Minor, and our heirs, assigns, personal representatives and estates, to assume all of the risks incidental to the Minor’s participation (which risks may include, among other things, injuries and broken bones). In further consideration of the Minor being allowed to participate in the Event, I, and on behalf of the Minor, hereby release and forever discharge the Released Parties (defined below), of and from any and all present or future liabilities, claims, actions, damages, costs or expenses (including all attorneys’ fees) of any nature arising out of or in any way connected with the Minor’s participation in the Event, including without limitation any claim for property damage and/or bodily and personal injury (including illness, paralysis and/or death) (individually a “Claim” and collectively the “Claims”). I further agree to indemnify and hold each of the Released Parties harmless against any and all Claims, regardless of whether any Claim is made by the undersigned, the Minor or any third party. The Released Parties are: Buffalo Bills, LLC; County of Erie, NY; Erie County Stadium Corporation; the National Football League Properties, Inc.; The National Football League and its member professional football club; the individuals, organizations, or entities involved in the sponsorship or activation of the Event; and the affiliated entities, officers, directors, employees, agents, representatives, successors, and assigns of each of the foregoing. I understand this release and indemnity includes any Claim based on the negligence, action, or inaction of any of the above Released Parties and covers bodily injury (including death) and property damage. I certify that I do not have knowledge of any medical or physical condition that would make it inadvisable for the Minor to participate in the Event. I grant each of the Released Parties the right and permission to use, throughout the world, the Minor’s name, face, likeliness, voice, and appearance whether recorded on or transferred to videotape, film, slides, photographs, audio tapes, or other media, now known or later developed, in connection with exhibitions, publicity, advertising, and promotional materials without reservation or limitation, and without claim for payment for such use. The Released Parties are, however, under no obligation to exercise said rights herein granted. I hereby agree to abide by the Rules and Regulations of New Era Field at all times during the Event. The laws of the State of New York shall govern this Waiver & Release without giving effect to the principles of conflict of laws. I certify to the Released Parties that I am 18 years of age or older, and I have the right and power to execute this Waiver & Release on behalf of myself, the Minor, and our heirs, assigns, personal representatives and estates. If any part of this Waiver & Release shall be declared to be invalid by any court of competent jurisdiction, such judgment shall not affect, impair, or invalidate the remainder hereof, which remainder shall continue in full force and effect. An electronically scanned copy of this executed Waiver & Release shall have the same force and effect as the original and I consent to the admissibility of such a copy in court in the event of a dispute.
I have read this Waiver, fully understand its terms and understand that I am giving up substantial rights by signing it. I sign this Waiver freely and voluntarily, without any inducement or coercion. I certify that I am the parent or legal guardian of the Minor.
