Unified Enterprises Corp., a Delaware corporation (the “Company”), is providing its guests an optional trip and transportation to an event in Cannes, France (the “Optional Event”) and the Company may also make available certain additional optional amenities during the Optional Event (including, but not limited to transportation, food and dining, drinks, recreational events, or other similar events or activities that are provided or offered by the Company) on such Optional Event (“Additional Optional Events”). If the participant whose name and signature appear are the signature page attached hereto, (“I”, “my” or the like) decide to participate in the Optional Event or any Additional Optional Events then, prior to participating the participant must sign this Waiver and Release of Liability in which participant acknowledges and agrees to the following terms:
1. I acknowledge that my participation in the Optional Event and any Additional Optional Events could cause injury to me. As a material consideration for the Company to permit me to participate in the Optional Event and any Additional Optional Events I, voluntarily and on my own behalf, assume all risks of personal injury, death, property loss or other damages which may result from or arise out of participation in the Optional Event or any Additional Optional Events. These risks include, but are not limited to, risks associated with transportation to or from the Optional Event and any activities either provided by the Company and/or activities I do outside of the Additional Optional Events provided by the Company. I understand that this waiver of liability will apply to any and all claims against the Company and/or its shareholders, officers, directors, employees, agents or affiliates (collectively, the Company’s “Affiliates") for any personal injuries, property loss or other damages in connection with or arising out of any of these risks. I agree to expressly assume and accept any and all risks of injury, sickness or death as result of my participation in the Optional Event or any Additional Optional Events.
2. I, on behalf of myself and my heirs, executors, administrators and assigns, fully and forever release and discharge the Company and its Affiliates from any and all claims, damages, demands, rights of action or causes of action, present or future, known or unknown, anticipated or unanticipated, resulting from or arising out of my participation in the Optional Event, any Additional Optional Events or my participation in any activities that fall outside of the Additional Optional Events but that I participate in voluntarily on my own while on the Optional Event, including those which arise out of the negligence of the Company or its Affiliates. Further, I release and discharge the Company and its Affiliates from any and all liability for any loss, or theft of, or damage to personal property.
3. I hereby acknowledge and accept that I take responsibility for myself and my invited guest, if applicable, with respect to any and all property damage, loss or other damages that occur at the housing provided by the Company on the Optional Event. I agree to act in a manner that positively reflects the Company at all times while on Optional Event or at any Additional Optional Events.
4. I hereby represent that I am of 21 years of age or at least the minimum legal drinking age mandated by the country that the Optional Event is taking place in. I, if I am bringing guest(s), take responsibility for representing that my guest is 21 years of age or at least the minimum legal drinking age mandated by the country that the Optional Event is taking place in. If I am an employee of the Company, I hereby take responsibility for any and all actions taken by my guest(s) relating to alcohol consumption or otherwise. If I or my guest(s) decide to drink alcohol while at the Optional Event or any Event, then I am expected to act responsibly, properly, and safely. I agree that neither I nor any of my guest(s) will violate any laws, including but not limited to, driving any vehicle after consuming alcohol at the Optional Event or any Additional Optional Events. I acknowledge that I am solely responsible for ensuring that my guest and I are acting responsibly.
5. I understand that drinking alcohol at an Event is at my option. I, on behalf of myself and my heirs, executors, administrators and assigns, fully and forever release and discharge the Company and its Affiliates from any and all claims, damages, demands, rights of action or causes of action, present or future, known or unknown, anticipated or unanticipated, resulting from or arising out of my drinking alcohol at the Optional Event or at any Additional Optional Event. Further, I release and discharge the Company and its Affiliates from any and all liability for any loss, or theft of, or damage to personal property that may occur as a result of my drinking alcohol at the Optional Event or any Additional Optional Event.
I, by signing below, acknowledge that I have carefully read and had time to consider this Waiver and Release, had it translated from English to my native language if necessary, and fully understand that it this is a waiver and release of liability.
