Paradisaea Aerial Dance Liability Waiver
I acknowledge that my participation and instruction in aerial arts and fitness at Paradisaea Aerial Dance entails known and unanticipated risks that could result in physical and/or emotional injury, paralysis, death, or damage to myself or third parties. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity. These risks include, among other things, exposing participants to the potential for slips and falling, rope burns, pinches, scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even severe life threatening hazard; strains, sprains, cuts, bruises, muscle soreness and fractures; musculoskeletal injuries, including head, neck, and psychological injuries, or physical damage associated with this activity.
Furthermore, Mary Young and Paradisaea Aerial Dance’s instructors have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a person’s fitness or abilities. They might give incomplete warnings or instructions and the equipment used might malfunction.
I expressly agree and promise to accept and assume all risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of these risks.
I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Mary Young and all other Paradisaea Aerial Dance Instructors from any and all claims, demands and or causes of action, which are any way connected with my participation in this activity or my use of Paradisaea Aerial Dance’s equipment or facilities, including such claims which allege negligent acts or omissions of Mary Young and Paradisaea Aerial Dance Instructors.
Should Mary Young, Paradisaea Aerial Dance Instructors, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage to myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
Studio Rules
Students are not permitted to teach other students during, before or after class, or during open practices.
Students must get instructor approval before practicing skills that were not taught to them by Paradisaea Aerial Dance.
Students are not allowed to practice anything that they have learned off of the internet. If a student wants to learn a skill they have not previously been taught in class, they can email the link to the instructor and the instructor will evaluate whether the skill is appropriate for the student’s level and if appropriate, the instructor will teach them that skill.
Students may not be under the influence of alcohol, illegal drugs, prescription drugs or over-the-counter drugs that may affect their focus and concentration.
Students must master a move at a low elevation before taking the skill higher on the apparatus.
Students must respect their bodies. They are responsible for listening to their bodies and not pushing them past safe working limits. Many factors (late nights, drinking, illness, stress, injury, etc.) can all affect an aerialists stamina. Be aware that your ability to safely execute skills and tricks may vary daily. It is up to the individual to let the instructor know if they feel that they are unable to safely execute a movement.
Students must follow and participate in the warm-up and conditioning as led by the instructor. Students must work on skills and tricks as directed and are not permitted to work on movements and poses previously taught at Paradisaea Aerial Dance unless the instructor allows open practice in class.
Students must not wear any jewelry or clothing that may catch and cause damage to the fabrics or pose a risk to the safety of the student.
Students are required to wear clothing that covers their midriffs and shirts that can be tucked in. Short shorts are not permitted. The fabric can irritate skin that is not covered and it is a safety issue when students are not covered up. Students are asked to tie longer hair back into a ponytail.
Students must be respectful of other students and instructors.
Students must seek permission from the instructor when taking photos in class. When posting on social media, students are asked to refer to Paradisaea Aerial Dance in their posts, either through direct tags, hashtags, or written references.
Paradisaea follows a three strike policy. The instructor has full discretion to ask students to sit out during class or leave class if they are exhibiting behaviour deemed to be unsafe or disrespectful. Students will not be issued a refund for any time they miss out on due to their behaviour.
There will be no make-up classes in the summer session.
Taking classes at Paradisaea Aerial Dance will expose you to intellectual property. Paradisaea Aerial Dance, class structure, movements, nomenclature, and its content, specifically including but not limited to that which is taught and used in all Paradisaea Aerial Dance fitness classes (silks, lyra, pole, aerial yoga, circus related classes, etc., hereafter referred to individually and collectively as “Paradisaea Aerial Dance”) are protected by both copyright and trademark and property rights and laws. By signing this agreement and participating in classes, you agree to use Paradisaea Aerial Dance intellectual Property, including choreography, solely within Paradisaea Aerial Dance for your personal and non-commercial use. No content may be instructed, photographed, videoed, published in print or on the Internet, downloaded, copied, reproduced, transmitted, stored, sold or otherwise distributed without the prior and express written consent of the Paradisaea Aerial Dance owner.
Non-compete: No person affiliated with Paradisaea Aerial Dance may use Paradisaea Aerial Dance property for commercial purposes, either with a business competitor or as a sole proprietor, within a forty kilometer radius of any Paradisaea Aerial Dance location or contracted location.
Pictures and videos of students taken in class or during performances may be used in any form of marketing/media that Paradisaea Aerial Dance sees fit, including but not limited to the Paradisaea Aerial Dance website, Facebook page, Instagram account, advertisements, posters or programs. By signing the below contract, you understand and consent to the use of pictures and/or videos of you being used in the above described ways.
