DRIVR, LLC., including its members, officers, directors, parent companies, subsidiaries, affiliates, including, but not limited to PAVR, LLC., VRWERX, LLC., Beast Media Group, LLC., and including, but not limited to, their agents, partners, distributors, licensors and licensees, which includes, but is not limited to, Paramount Pictures, Steam, Valve, Nvidia, Inc., HTC, and their respective parent companies, affiliates, and subsidiaries (collectively the “DRIVR Parties”) may provide you with the opportunity to try or participate in virtual reality content at the 2018 EGLX Gaming Expo demo stations and/or at other ad hoc demo areas (“Demo”). These Demos are not for children under 13. If you are under the age of 18, you need permission from a parent or guardian to participate in the demo experiences.
The Demo is intended to be fully immersive and may scare, startle and surprise you. Some Demo content may be in a rough or unfinished state, which may heighten or increase the likelihood of experiencing motion sickness, nausea, disorientation, visual abnormalities, or other discomfort which can be common symptoms when experiencing virtual reality (“VR”). You agree that your participation at any Demo is at your own risk.
General Warning for VR: Immediately discontinue the Demo if you experience any of the following symptoms that can occur with VR: seizures; loss of awareness; eye strain; eye or muscle twitching; involuntary movements; altered, blurred, or double vision or other visual abnormalities; dizziness; disorientation; impaired balance; impaired hand-eye coordination; excessive sweating; increased salivation; nausea; lightheadedness; discomfort or pain in the head or eyes; drowsiness; fatigue; or any symptoms similar to motion sickness. Just as with the symptoms people can experience after they disembark a cruise ship, symptoms of virtual reality exposure can persist and become more apparent hours after use. These post-use symptoms can include the symptoms above, as well as excessive drowsiness and decreased ability to multi-task. These symptoms may put you at an increased risk of injury when engaging in normal activities in the real world.
If you are susceptible to any of the above conditions, please advise the attendant before participating. If you experience any of these symptoms, stop immediately, advise the attendant, and do not engage in activities that require unimpaired balance and hand-eye coordination until you have fully recovered. Do not participate in or go through a Demo if you have been consuming or are under the influence of alcohol or drugs or have any kind of pre-existing medical condition. Please be advised that with or without a pre-existing medical condition VR may be the cause or contributing cause to medical problems of the nature described above, seizures or even heart attacks.
Some people (about 1 in 4000) may have severe dizziness, seizures, epileptic seizures or blackouts triggered by light flashes or patterns, and this may occur while they are watching TV, playing video games or experiencing virtual reality, even if they have never had a seizure or blackout before or have no history of seizures or epilepsy. Such seizures are more common in children and young people under the age of 20. Anyone who has had a seizure, loss of awareness, or other symptom linked to an epileptic condition should not participate in a Demo.
DRIVR, LLC does not make any claims or representations about the VR equipment or technology that you will use for the Demo and/or the content displayed therein. The Demo is being provided “AS IS” and any express or implied warranties are hereby disclaimed.
In consideration and acceptance of the Demo, you agree to release the DRIVR Parties from any and all liability from any harm, injury, death, cost or expense whatsoever that may arise directly or indirectly from the Demo. Further, by signing below, you grant the DRIVR Parties the irrevocable right and permission to use your name, likeness, photographs or video of you, or that of your child’s (if applicable), on or in connection with any DRIVR Parties’ promotional materials, including, but not limited to websites, social media platforms, advertisements, blogs, and videos for any purpose and without compensation to you. You agree that all such photographs, videos, audio recordings and reproductions thereof are and shall remain the property of the respective DRIVR Parties and you hereby release the DRIVR Parties from any and all claims, demands damages or liabilities arising out of or in connection with their use or distribution, including but not limited to claims for invasion of privacy or appropriation of likeness. You hereby agree that the DRIVR Parties may use the information provided below for promotional purposes including to contact you with promotional communications.
