The Saugatuck Rowing Club, LLC is authorized, by the above Member Signature, to collect membership dues and club account charges bimonthly with the credit card so designated. Monthly membership dues and accrued account charges shall be drawn on the 1st and 15th of each month (or the first business day thereafter). The transactions on your credit card statement will constitute receipts for payments on your account. Payment is due regardless of Club usage by Member. There will be a $15.00 service charge in the event of a credit card decline.


BUYERS RIGHT TO CANCEL

The term of this agreement is 12 months. You may cancel this contract during the first 3 days by informing the Club in writing that you would like to cancel the contract. During the first year, if you move more than 25 miles from the Club, you can cancel the contract for the remainder of the year. If you become disabled during the first year, you can either cancel the contract or continue the contract without any monthly cost during your disability. After the first year, membership is on a month-to-month basis, and Member may terminate with a 30-day prior written notice.

TERMS OF THIS AGREEMENT FOR SERVICES

1. Complete Agreement

Employees of The Club are not authorized to make any changes to this Agreement, written or verbal, or to make any independent agreement with the member pertaining to the membership. This Agreement constitutes the entire Agreement between the parties, and the Member is not relying on any other representation. This Agreement may only be modified in writing signed by the two parties.
2. Substitution of Equipment
Member agrees that The Club has the right to substitute equipment/facilities as deemed necessary by Management. No refund whatsoever will be given for equipment or facilities temporarily out of order.
3. Club Hours
Club Operating Hours are subject to change based on seasonal demand. The Club may be closed for certain holidays, maintenance, repairs, emergencies, weather, etc. Members will have no claim against The Club for extending or providing additional credit for period closed. Management reserves the right to limit Club usage for special occasions or events.
4. Club Equipment and Services

6. Club Fees
Initiation Fees and Monthly Fees will change from time to time. Check with the Club manager for the current fees.
7. Guest Policy 
Members are allowed to have guests accompany them to The Club at a fee of $25 per guest per visit unless otherwise approved by The Club at no additional charge. A waiver signed by the guest must be on file at The Club. The same guest may not visit the club more than 3 times per month.
8. Member Address
The member address and contact information shall be as set forth on the front of this agreement. If changes occur for any contact information the member shall advise the Club in writing.
9. Services, Membership Rights and Term of Agreement
Club Services provided to the member are given in Club literature and website. The Club reserves the right to alter its operating hours and reservation procedures for all programs and services. Club membership is non-voting and no rights of ownership are conferred. The term of this agreement is 12-months, subject to provisions of last paragraph on the front of this contract.
10. Payment and Club Dues Notices
Dues are subject to review and change by The Club. Member shall be notified in writing of such change. The Member shall give notice to The Club of any change in credit information for electronic credit card draft, address and telephone number.
11. Dishonored Check or Credit Card
It is understood that there is a minimum $15.00 bank handling charge for any transaction not honored by the Member’s bank.
12. Suspension & Termination of Membership by The Club
In the event that the Member behaves in a manner contrary to the Membership rules, The Club may suspend and/or terminate this membership and seek all legal remedies available to it, including its reasonable attorney s fees.
13. Default
If there is default in payment of any fees when due or default or other breach of the terms hereof (after written notice thereof), then The Club may on notice to the Member terminate this Agreement. In such event, the Member is required to pay the unpaid balance of all dues under this contract, all Club charges and all costs of collections including reasonable attorney’s fees.
14. Initiation Fee
The Initiation Fee is a one-time only payment, not subject to pro-rata refunds. Should the Member discontinue payments, by default or for any unauthorized reason, any subsequent new membership obtained shall be subject to the then current initiation fee. A Member whose Agreement has expired may renew within 30 days without added Initiation Fee.
15. Rights to Medical Leave
A medical freeze, at no charge, will be granted only to members who present a Doctor’s note. The note must be dated and list the time in which the member will be unable to use the Club. If a time period is not listed, then a 2-month maximum freeze will be given. In order to extend the freeze, a new note must be given at the end of the 2-month period. This does not apply to unforeseen accidents or emergencies. Medical freezes do not have a minimum time period, but do have a maximum period of 1-year. After 12-months of medical freeze, you will have the option of resuming full monthly dues payments or terminating the membership. If membership is terminated, re-entering SRC will require payment of a new initiation fee.
16. Rights to Vacation Leave
Member may request vacation leave status up to 3 months per year, during which time the monthly membership fees will be reduced for that period of time to amount of $25.00/month of leave.
17. Family Membership
There is an initiation fee and dues fees required for each family member (over the age of 18). To qualify as a family member, the current permanent address has to be the same as the primary member on the front of this agreement. All dues and fees will be the responsibility of, and appear on the account of, the primary member, unless otherwise noted.
18. Children 12 years of age and up (accompanied by a parent or guardian member of SRC)
 Parent/Guardian must sign a waiver for the child to enter the fitness center
 Only allowed to enter the fitness center after 12pm Saturdays and Sundays
 Guest fee of $25 is waived for children of members (children under 18)
 Child must be accompanied by parent/guardian or trainer at all times
 Children are not to be left unattended anywhere in the club
 Children are not allowed to workout with parents in the boathouse
 SRC staff reserve the right to ask parents to remove children from the facility if safety is a concern
19. 12 Children under the age of 12
 Children UNDER the age of 12 are not permitted in the fitness area
 Children UNDER the age of 12 must wear a life vest on the docs at all times


WAIVER OF LIABILITY

The undersigned, Member, understands that all equipment and facility usage and all exercises shall be undertaken by Member at his or her sole risk and that the Saugatuck Rowing Club, LLC (SRC) or any of its associates shall not be liable to Member for any claims, demands, injuries, damages, action or causes of actions, whatsoever to his/her person or property arising out of or connected with the use by him/her of the services of, or facilities of, the SRC or on the premises where the same is located. Member understands that insurance on privately owned boats is the sole responsibility of the boat owner and that SRC cannot be held liable for any damage or loss, including fire or theft, of Member’s boat(s). Member does hereby expressly forever release and discharge the SRC and any of its associates from all claims, demands, injuries, damages, actions or causes of action, and from all acts or active or passive negligence on the part of the SRC or any of its associates. Additionally, the Member acknowledges that he or she has received, and agrees to abide by, the SRC Safety Rules with consideration of rules or regulations that may be implemented in the future. IN CONSIDERATION of being given the opportunity to participate in any Saugatuck Rowing Club (Club) activities (Activity), I, for myself, my personal representatives, assigns, heirs, and next of kin:

1. ACKNOWLEDGE, agree and represent that I understand the nature of Rowing Activities, both on water and land based, and that I am qualified, in good health, and in proper physical condition to participate in such Activity.

2. FULLY UNDERSTAND that: (a.); ROWING ACTIVITIES INVOLVE RISKS AND DANGERS of serious bodily injury, including permanent disability, paralysis and death (“Risks”); (b.) these Risks and dangers may be caused by my own actions, or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or the negligence of the Releases names below; (c.); there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation in the Activity.

3. AGREE AND WARRANT that I will examine and inspect each Activity in which I take part as a member of the Club and that, if I observe any condition which I consider to be unacceptably hazardous or dangerous, I will notify the proper authority in charge of the Activity and will refuse to take part in the Activity until the condition has been corrected to my satisfaction.

4. HEREBY RELEASE, discharge, and covenant not to sue US Rowing, the Club, their administrators, directors, agents, officers, volunteers and employees, other participating regatta organizers, any sponsors, advertisers, and if applicable, owners and lessors of premises, on which the Activity takes place, (each considered on of the Releasees herein) from all liability, claims, demands, losses or damages on my account caused or allege to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations; and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY AND SAVE AND HOLD HARMLESS each of the Releasees, from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as a result of such claim.

I have read this agreement, fully understand its terms, understand that have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
