Intending to be legally bound, in consideration of the services of Party Point, LLC and Under Armour, Inc., their agents, owners, officers, volunteers, participants, employees, equipment suppliers, and all other persons or entities acting in any capacity on their behalf, I hereby agree to release, indemnify, and discharge Party Point, LLC and Under Armour, Inc., on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:
1. Acknowledgement of Bull-Riding Risks: I acknowledge that riding a mechanical bull entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. I understandthe demands relative to my physical condition.
2. Potential Injuries: THE RISKS INCLUDE AMONG OTHER THINGS: The risks of mechanical bull-riding may cause minor, serious, or even catastrophic injury to persons. Catastrophic injuries can include permanent disabilities, spinal injuries, heart attack, stroke and even death. I understand the types of injuries that might result from mechanical bull-riding. Furthermore, Party Point, LLC and Under Armour, Inc. employees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participants’ fitness abilities. They may give incomplete warnings or instructions, and the equipment being used might malfunction.
3. Medical Conditions: It is my responsibility to consult with my physician before participating in mechanical bull-riding to ensure that my participation will not pose any unusual risks to my health or well-being. I do not have any conditions that would be made worse by mechanical bull-riding.
4. Medical Treatment: Any medical treatment resulting from may participation shall be at my own expense or the expense of my personal insurer(s)
5. Assumption of Risks: I expressly agree and promise to accept and assume all of the risks existing in mechanical bull-riding. My participation in this activity is purely voluntary, and I elect to participate in spite of risks. I take full responsibility for any and all damages, liabilities, losses, or expenses that I may incur as a result of participating.
6. Indemnification Agreement: I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Party Point, LLC and Under Armour, Inc. from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of Party Point, LLC and Under Armour, Inc. equipment or facilities, including any such claims which allege negligent acts or omissions of Party Point, LLC and Under Armour, Inc.
7. Participant’s Acknowledgement of Understanding: In order to be permitted to participate, I have read this form completely and carefully. I acknowledge that my participation is voluntary. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Party Point, LLC and Under Armour, Inc. on the basis of any claim from which I have released them herein.
I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS.
