I, the person named as “Participant” below, (“Participant”), acknowledge that the Amazon Treasure Truck Johnson & Johnson Pop Up (the “Event”) involves a high risk of personal injury and property damage. I knowingly and voluntarily agree to assume all of the risks of participating in this Event, whether foreseeable or unforeseeable, including, but not limited to, those caused by facilities, temperature, weather, equipment, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, Event officials and/or producers of the Event.
I agree to follow all instructions of Event organizers and to wear safety equipment required by Event organizers upon request. I agree to assume all risks associated with my failure to wear safety equipment. I agree that before I participate in any portion of Event, I will inspect the related facilities and equipment. I will immediately advise Event personnel of any unsafe condition that I observe. I will refuse to participate in the Event until all unsafe conditions have been remedied.
In exchange for being permitted to participate in this Event, I agree for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I waive, release and discharge [Amazon, Johnson & Johnson, Allied, Westfield World Trade Center, The Port Authority of New York and New Jersey] and their respective parent companies, subsidiary companies, and affiliate companies, and each of their respective partners, owners, officers, directors, successors, assigns, employees, representatives and agents, Event broadcasters, other Event officials, volunteers and participants (“Released Parties”) from any and all injuries (including but not limited to disability, dismemberment and death), illness, loss, claims, causes of action, liabilities, damages, expenses or claims (collectively, “Claims”) resulting from my participation in the Event, including without limitation, the negligent acts or omissions of the Released Parties in connection with the Event or the condition of the property, facilities or equipment used for the Event, regardless of when such Claim may arise. I agree to indemnify, defend and hold harmless Released Parties from any and all Claims arising from my acts or omissions in connection with the Event.
I am in good health and have no physical or mental conditions that affect my ability to participate in the Event and have not been advised otherwise by a medical practitioner. I am not currently taking any medications, drugs or other substances that will impair my ability to exercise sound reasonable judgment and my ability to participate. I hereby consent to receive medical treatment, which may be deemed advisable by on-site medical personnel in the event of injury, accident or illness during this Event. I agree not to sue Released Parties for any liabilities resulting from medical malpractice committed by medical professionals.
I give permission for Released Parties to use my biography, image, appearance, name, voice, photograph and likeness (“Appearance”) throughout the world in perpetuity in any and all media now known or hereafter devised in connection with the Event and broadcasts, publicity, advertising, and promotion of the same, including future editions. I waive any right that I may have to inspect or approve any item that may use Appearance in connection with the Event.
I agree to conduct myself in a professional manner and treat all colleagues, officials and spectators respectfully. I realize that if disciplinary action is taken against me, I may be immediately removed and suspended from the Event and future Events. Any disciplinary action is nonappealable and in the sole discretion of the Released Parties or Event officials. I hereby release Released Parties from any and all claims related to my removal and/or suspension from the Event.
This Waiver is a legally binding agreement and shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. Any provisions found to be void or unenforceable shall be severed from this agreement, and not affect the validity or enforceability of any other provisions.
I HAVE READ THIS DOCUMENT AND I UNDERSTAND ITS CONTENT. I SIGN ON BEHALF OF MY HEIRS, SUCCESSORS AND ASSIGNS. I UNDERSTAND THAT BY SIGNING BELOW, I HAVE GIVEN UP SUBSTANTIAL RIGHTS IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE EVENT. I VOLUNTARILY, FREELY AND WITHOUT ANY INDUCEMENT OR DURESS SIGN THIS WAIVER AND RELEASE FROM LIABILITY.
